Welcome to Primetime Crime. I'm your host, Kylie. Let's talk right now on true crime, and then together we are going to work on warming up some cold cases. Let's go Hey, guys, welcome to another episode of Primetime Crime. It's Kylie. We are going to go ahead and dive in to right now and true crime before we get into this week's episode. So, first thing is first, the jury. Officially has the case against Richard Allen the Delphi trial. I will try to keep you guys updated as much as I can via social media as far as if a verdict is reached. But honestly, the trial, in my opinion, was messy on both sides. I don't really know much else what to say about it other than I feel like it was a bit of a disaster all the way around. I do feel like there were some very intriguing parts of it. I personally feel like Richard Allen is guilty. I just don't know if the jury is going to be able to say that without a reasonable doubt he is guilty. But I will continue to keep you guys updated on anything that goes on in that because I feel like they're either going to get a verdict quickly or it's going to be a while. We shall see. Next thing I want to talk about is Micah Miller. If you guys remember me talking about her, she was the woman who allegedly committed suicide, and then there was a lot of talk that her husband, who was a pastor, allegedly. Drove her to suicide. And there's just been a lot going on surrounding him, not necessarily in relation to Micah's death, but there were some financial crimes and stuff that he was being investigated for. And then he decided that he was going to assault a. Justice for Mica protester that was outside of his church. So he was charged with third degree assault and battery. And then this morning he was arraigned and he was given a seven hundred and seventy six dollars bond during a twenty minute hearing that happened this morning. He did spend Wednesday night in jail. He is scheduled to be back in court on December tenth. But there is no secret that John Paul Miller is a horrible human in my opinion, and there is so much bad stuff surrounding this man right now, and I think it's just going to continue the it's just going to continue to pile up on him and pile up on him until it all just comes to a breaking point, which I feel like it's really really close. But I will continue to keep you guys updated on all of that. But twenty twenty four has not been John Paul Miller's year, and I hope that it continues to get worse for him because he is not a good person. So Idaho murder trial update BKA was in court today because they are basically arguing that the death penalty needs to be taken off of the table, and they go on about a bunch of different things regarding the death penalty and having him sit on death row would be inhumane, and you guys know how I feel about the death penalty, but Brian Coberger allegedly took four lives in such a horrendous and heinous way that there's no way that you can tell me that him sitting on death row would be inhumane for him, the person that took four lives of four young adults while they were simply sleeping at night. Anyways, the judge said that he will make a ruling at a later date, but that's basically what the hearing was about, was the defense wants it taken off of the table. The prosecution, of course, doesn't want it taken off the table. So I'll keep you guys updated on what transpires there. I kind of just have a feeling that they're probably going to keep it on the table, and if he is found guilty, he probably will be sentenced to death. That is just my gut feeling, my opinion. Once the jurors hear the horrendous, horrificness of the details of the crimes that he committed, there's going to be no way that they don't if they do find him guilty, there's going to be no way that they don't sentence him to death if it is on the table. But I will keep you updated as more comes through for that. Also, another really interesting fact about Idaho and their death penalty is they do it by lethal injection, but there's been an issue lately, I guess, with them being able to get the lethal injection drugs. So they've also made it legal for there to be a firing squad as part of the death penalty, so not just lethal injection, but also a firing squad. So if he is put to death, it could be by a firing squad, which completely my mind. That's going to be a different topic for a different time because I'm not. Entirely sure how I feel about it. I feel like in his case, if he is guilty, then that is probably a warranted. Sentence, And I don't know. I have mixed feelings about the death penalty, and I still haven't quite figured out my feelings about it, if. I'm being honest. But like I said, anything that goes on with that, I will keep you guys updated, all right. Last thing I'm going to talk about real quickly is Sarah Boon. She was officially found guilty of killing her boyfriend by leaving him in a suitcase and basically he's suffocated inside of the suitcase. She is still awaiting her sentencing, but she is already wanting a new trial, and she is arguing prosecutorial misconduct and the judge making bad rulings. So as with any guilty verdict, there is always an appeal process. It is just how it goes, and they're always going to be grasping its straws saying prosecutorial and misconduct, judge issues, jury issues, whatever the case may be, it is just part of the process of the appeal, So I will keep you guys updated on that one. But like I said, her sentence hasn't even happened yet. But that will be happening here, I want to say this month. That's happening in November, So more updates. To come on that. And with all of that, we are going to go ahead and get into this week's episode. Okay, guys, Today we are going to be talking about the unsolved two thousand and six homicide of a twenty nine year old man named Toby bo in New Orleans, Louisiana. So I learned about Toby's story watching the Cold Case oposium that I was able to attend virtually because I was homesick, and I got to hear a little bit about Toby's story from his sister Claire. So we are going to go ahead and get into Toby's story now. Toby John Bow was born on June ninth of nineteen seventy six in Lafayette, Louisiana, to his parents, Terry and Cindy. He also had a sister named Claire, who I mentioned earlier. Toby was a graduate of Saint Cecilia Saint. Thomas Moore in nineteen ninety four. And he received a bachelor's degree in psychology from the University of Louisiana at Lafayette. At the time of his death, he was in the process of pursuing an accounting degree at the University of New Orleans. Toby met his wife, Melissa in two thousand and one, when Melissa was in law school at Louisiana State University. They ended up marrying in. April of two thousand and five and decided to make New Orleans their home. Toby was working in the truck division of Enterprise rent A. Car and was very successful at his job. In August of two thousand and five, Hurricane Katrina hit New Orleans and it was devastating for those that lived in its path. And when I think back to Hurricane Katri, it doesn't seem to me that it was almost twenty years ago. But here we sit in twenty twenty four and it was almost twenty years ago. It is just wild to me that so much time has passed, and Hurricane Katrina brought so much devastation to the city of New Orleans and surrounding. Of course, so Melissa and Toby. Did end up evacuating for Katrina, but they still called New Orleans home. That was their home, that. Is where they lived, and that is where they enjoyed being. So Toby and Melissa had planned to let Toby finish school and then they would from there think about going on and adding to their family and having children. So they very much had a good life. They were happy, and they were planning for their future. Toby was loved by. Everyone and had a lot of friends. The couple always walked everywhere, they rode their bikes all over And what happened to Toby, it was just. A normal day, normal night in their life. They were doing what they always did, and the unthinkable happened. So we're going to get into that. So that brings us to February twenty fifth of two thousand and six, which was a Saturday night. It was the city's first Marti Gras since Hurricane Katrina had hit. So this was a big deal for the city of New Orleans. It was kind of more of a celebration of them coming back together, things reopening, people rebuilding all the things. The city was very much still in a rebuilding phase. Many businesses and homes at this point were still boarded up, but Louisiana did what it always did, and they tried to bring some normalcy back to his residence. Toby's favorite holiday next to his birthday, was Marti Gras, and due to all the devastation that the city had faced, I imagine that this Marti Gras was probably a little extra special for the residents of New Orleans. Melissa and Toby had a fun night out. Besides regular Marty Girls activities, they also had spent some time watching a parade from a Saint Charles Avenue balcony. It was just a normal night. They were in the process of walking home when the unthinkable happened. As the couple went across Jenna. Street at Magazine Street, there was a black truck that made a sharp right turn. And when this happened, it startled a couple. Obviously I would be startled as well, and they were a little taken aback by this, But there wasn't any like verbal altercation or words or threats or anything like that that were exchanged, and Melissa and Toby just assumed that it was a driver not paying attention to where they were going, so they ended up continuing their walk and Melissa was a few steps ahead of Toby, and suddenly the truck appeared again, and it seemed like it had essentially circled the block in order to run into Toby and Melissa once again, almost like they were taunting them. The truck stopped on the corner and Toby paused with his arms outstretched, facing the driver, kind of like, what's your deal, what are you doing? Why are you following us? Leave us alone? Basically, And with that, the driver suddenly stepped on the gas and gunned it headed for Toby and ran him over in the middle of the street, in the middle of the night, for no reason at all. So unfortunately, Toby lost his life that night, and the driver sped off and literally just faded into the night and blended in with the rest of society. And there is very. Little information known about the driver or about the truck itself. Melissa did witness it, however. It was a moment of what I'm sure is deep trauma for her, and I can't even imagine how fast everything likely played out between them first seeing this truck and it actually running over Toby. It was a very very short timeframe, and you never ever think in your normal everyday life that when you're walking home from Marti Gras, which you have done probably every single year, that you're gonna get hit and that someone is going to run your husband down. That's not something that you normally would think would happen. So I'm sure in the moment Melissa had just no even time to react to what was happening because it all happened so fast and deep trauma watching your husband and love of your life get run over by some crazy maniac in a truck. The truck is described as a black pickup with an extended cab. They do believe that the truck. Resembled a Toyota Tacoma and they are looking for a white male who had been driving it. Unfortunately, due to the location of the hit and run and the fact that it was so soon after her Kan Katrina, the infrastructure wasn't there with security cameras. To help capture the person who did that us. Everything was still pretty much in a rebuilding mode, so the normal CCTV cameras and all. Of that just were not there. But whoever this person is that ran Toby over, there is no doubt in my mind that they have no regard for human life to be able to do that to somebody unprovoked and ride off with no regard for what they just did completely astonishes me. I don't even know why somebody would have this in their mind to even try to orchestrate something like this and then. Just drive off. So there isn't a lot to go on with this. So what can we as a true crime community do to help this case? With little to no information to go on. This is one of those cases where the missing piece may lie with someone that doesn't even realize that they have the information. I would imagine that the person driving this truck must have some type of front end damage following this hit and run. The suspect could have brought the truck in for They also could have altered the car in hopes. To avoid being identified. Another alternative is that if you knew someone with the vehicle that matched this description and then suddenly after that weekend it disappeared, that could also. Be a potential clue. The driver could have been a New Orleans local, somebody in town for Mardi Gross, somebody just passing through for work. We really don't know either way. It was definitely a random attack and it seems that Toby and his wife were violently attacked on their way home for seemingly no reason. They literally did nothing wrong. All they were doing was walking home. They were targeted, Their lives were changed that night, and it's just super unfair and super wrong that all of this transpired. The way it did. Anyone who has maybe heard a version of the story and thinks that it might be connected to Toby's death is urged to call the authorities. It's likely, and this is just my opinion, that this one incident was not an isolated incident, and this person probably has a pattern of unruly behaviors behind the wheel, probably a lot of road rage type incidents that they've been involved in in the past and probably since. And I know that. Toby's family desperately wants answers and for justice to be served, and they deserve it. They really deserve to find out what happened to Toby. I also think that this case getting solved does lie in the hands of somebody who probably doesn't even realize that they know something about what happened. I'm sure the person that did this probably at some point in time told somebody that they did something like this. The person that they told. Probably just shrugged it off, thinking that they were just joking around. Maybe they had been drinking and they were just kind of talking. But this is something that I feel like easily could be solved with just somebody coming forward and saying, oh, yeah, I knew so and so, and they said that they had done something like that at some point in time, but I. Didn't really think that they were serious. Or yeah, I knew so and so had a pickup truck and then after that weekend it disappeared, or I knew somebody that had some front end damage to their vehicle and they had brought it to my repair shop to get fixed. And this was around the time of Toby's murder. And it might have been in New Orleans, it might have been Louisiana, it might have been across the United States. For all we know, this person really could have been in town for anything. And I'm sure this person has probably, maybe not to the extent of Toby's case, but they probably have done something unsavory behind the wheel of a car before and since. And this person has no business. Being out and about to callously run somebody down for no apparent reason when you're the one who's driving like a jerk, and all they're doing is reacting to what you're doing, like you don't deserve to be out and about amongst everyone else living your life. Well, Toby never got to live past twenty nine years old. It's sad, it's horrible. I know Toby's whole family, his sister Claire, his mother, his widow Melissa, they all need justice. They all deserve justice, and they all want answers as to what happened to Toby. This one is a little. Bit more difficult because we don't have a lot of information as far as who this person could be. It obviously was a random attack. It's not something that was pre planned, premeditated necessarily, but the person still chose to do something really poor and take somebody's life that night for no reason at all. But there really isn't a lot to go off of. So that's kind of. The issue with the story because it is just kind of sitting in limbo and you never know of the person that you're walking by in a crowd of people is the person that murdered Toby. You just don't know. This person could be the most stand up citizen on earth. They might have been drinking that night and made a really poor decision and then ran off because they were scared, and rightfully so, but they still took a life that night, and they still, in my opinion, need to pay for that and give the family closure because not knowing, like I always say, has to be the hardest part of all of it is just not knowing why and who, and there's never going to be a reasonable explanation for taking someone's life, especially in such a random. Way such as this. But I think having a little bit of closure for the family would go a long way because they have gone so long, almost twenty years, seeking justice for Toby. Of course, you can remain anonymous, and this might be just what this case needs to reinvigorate and hopefully bring somebody to justice for taking the life of Toby bo In the midst of him having a good time with his wife, coming home from Marty Grass, minding his own business, doing what they always did, and responsibly walking home after they had been out all night. If anything else, this. Is just going to hopefully get Toby's name out there a little bit more and share his story, because his story deserves. To be told. I know this episode was a little bit shorter in. Length, and I feel like sometimes I kind of steer away, stray away from doing episodes that don't really have a lot of background information in them because I feel like I want to at least. Take up twenty minutes. But I'm going to stop that because these stories deserve to be told. They need to be shared, and just as much as any other case, they deserve to have their names out there and to have more eyes and ears on their stories.
